Osun state governor elect, Adebayo Adeleke has won the case filed against him by Babayemi Abmysmal as the supreme court struck out the suit on Thursday.
The court asked the Appellant if notice of appeals filed out of time is competent and he responded that they relied on Interpretation Act But the court maintained that, Interpretation Act does with respect to dates is not applicable in election matter.
Worthy of note is that, the Appellant filed a Notice of appeals earlier but he filed another one and opted to abandon the earlier one.
However, the second Notice of Appeals was filed out of time.At the end,, the Appellant withdrew the appeal and the case is over.
